ملخص:

لأن أحداث الزمان متجددة، ويحتاج كل حدث منها إلى فتوى تناسبه، تُسْتَمد من قواعد الإسلام وأصوله.

ولما كان أمر الفتوى يدور بين السائل والمجيب أو بين المفتي والمستفتي، كان لابد من توفر بعض الشروط اللازمة لكل منهما حتى يستقيم أمر الفتوى.

وقد جعلت بحثي هذا بعنوان: (أدب المفتي والمستفتي) وجعلته في مقدمة وثلاثة فصول هي:

الفصل الأول: تعريف الفتوى ومشروعيتها وحكمها.

الفصل الثاني: منزلة الفتوى وأركانها.

الفصل الثالث: شروط المفتي، وآدابه وآداب المستفتي.

وختمته بجملة من النتائج والتوصيات اللازمة.

والحمد لله رب العالمين 

Abstract 

Because the events of the time is renewed, and each event needs a suitable Fatwa that is being derived from the rules of Islam and its principles, and because the issue of Fatwa is between the questioner and the respondent or between the Mufti and Mustafti (poller), it was necessary to have some conditions for both of the Mufti and Mustafti in order to get the correct Fatwa. 

My research is entitled (The Morals of Mufti and Mustafti) and I have structured it in an introduction and three chapters:

Chapter one: The definition of Fatwa and its legitimacy and ruling.

Chapter two: The position of Fatwa and its pillars.

Chapter three: The conditions of Mufti and his morals, and the morals of the Mustafti.

I concluded with some results and recommendations.
